History of the Canadian Medical Marijuana Program

Marijuana has been used for centuries as a source of medicine, a common medicinal plant from ancient times. Even as technology became part of our lifestyle, it was seen as a viable cure for many ailments. However, in 1923, the Canadian government banned marijuana. Although marijuana cigarettes were seized in 1932, it took nine years after the law was passed, fourteen years before the first marijuana possession charge was filed.

the United Nations signed an international treaty known as the Single Convention on Narcotic Drugs, which established four lists of controlled substances. Marijuana officially became an internationally controlled drug classified as Schedule IV (the most restrictive).

The treaty also obliges member states to set up government bodies to supervise cultivation. The requirements also include the criminalization of all processes of the planned drug, including cultivation, production, blending, possession, sale, supply, export, etc. Canada has signed an agreement with Health Canada as the government agency.

To remove marijuana from the IV classification or schedules. However, since hemp was specifically mentioned in the 1961 Congress, the amendment would require a majority vote of the committee members.

Canada’s Medical Marijuana Laws Are Changing

The wording of the agreement seems clear; states that signing the treaty must treat marijuana as Schedule IV with appropriate penalties. However, several articles of Congress contain provisions regarding the medical and scientific use of controlled substances. In 1998 the Cannabis Control Policy was published: a discussion paper. The Cannabis Control Policy, written by the Department of Health and Welfare in 2022, summarized Canada’s responsibilities:

Discretion in the provisions of international drug conventions that require Canada to criminalize certain cannabis-related conduct. It is argued that these obligations only cover conduct related to illegal trade, and that even if Canada chooses to criminalize consumer-oriented conduct; it has no obligation to convict or punish those who commit these crimes.

The obligation to limit possession of cannabis products to legitimate medical and scientific purposes is subject to administrative and distribution controls, and while it may require the seizure of cannabis in possession without a license, it does not oblige Canada to criminalize such possession.

Recent medical research suggests that medical marijuana use may play an important role in reducing the progression of the dreaded Alzheimer’s disease. Its main ingredient, Tetrahydrocannabinol or THC, reduces and prevents the deposition of neural proteins deep in the brain. These deposits are mainly responsible for this degenerative nerve condition. The therapeutic cannabis that medical marijuana provides controls the build-up of the proteins or sticky amyloid plaques that cause neuronal damage, disrupt memory and cognition, cause severe memory loss and cause confusion, irritability, mood swings, spatial disorientation and speech difficulties.

Resulting in memory loss, dementia and impaired motor skills, as well as impaired intellectual and social skills. Alzheimer’s disease is one of the top 10 causes of death among the elderly in the United States. Research shows that medicinal cannabis is an effective treatment for Alzheimer’s disease and some of its symptoms.

While list of authorised prescribers sa (MMJ) is legal in some US cities, all MMJ cardholders are required to obtain cannabis from a legal pharmacy. MMJ Pharmacy can also guide the patient in obtaining a medical card for marijuana.
