Mexico and Germany are signatory states of the Hague Convention of October 5, 1961, which abolishes the requirement of legalization of foreign public documents. The apostille replaces the legalization.

The apostille is issued by the competent authorities of the country that issued the public document. The embassy cannot issue Apostilles.

The embassy generally no longer “legalizes” documents.

Apostille

The apostille consists of a specific text that certifies the authenticity of the signature, the capacity in which the signatory of the document has acted and, where appropriate, the identity of the seal or stamp with which the document is covered. The apostille is placed on the document itself or on an extension of it. The title “Apostille” should be mentioned.

Agencies that issue apostilles in Mexico

In the case of state or local public documents issued in the States of the Mexican Republic (such as birth/marriage/death certificates) that must be used in Germany, they must be apostilled in the corresponding office according to the following*:

The documents issued in any State of the Mexican Republic must be apostilled in the General Secretariat of the corresponding State.

Federal documents must be apostilled by the Ministry of the Interior.

Documents issued by authorities of Mexico City must be apostilled at the Legal and Legislative Studies Directorate of the Government of Mexico City.

Agencies issuing apostilles in Germany

Public documents of the Federation

a) For public documents issued by all federal agencies and courts (except those mentioned in subsection “b”):

  • Federal Office of Administration Cologne
  • Division II B 4
  • 50728 Cologne

b) For public documents issued by the Federal Patent Court and the Federal Patent Office:

  • The President of the Federal Patent Office
  • Public documents of the Federal States

For public documents issued by the dependencies of the supervision of justice, of the civil/criminal courts and notaries:

  • The Ministries of Justice of the federated states (or senators of justice),
  • The presidents/magistrates of the courts

For public documents issued by the other courts:

  • The Ministries of the Interior of the federated states (or senators of the interior),
  • The President of the regional administrative district,
  • The Ministries of Justice of the federated states (or senators of justice),
  • The presidents/magistrates of the courts

All administrative dependencies (except justice administration dependencies):

  • The Ministries of the Interior (or senators of the interior),
  • The President of regional administrative district,
  • The State Administrative Unit
